Fundamental Rights: Identify the Right and the Remedy

Lesson 4 of 66 minFree

Learning goal

Identify a few foundational rights, read who receives a protection, and keep Article 32's remedy tied to Part III.

Read the Article's actual scope

Part III contains Fundamental Rights. Article 14 concerns equality before law and equal protection of laws for persons within India. Article 19 gives specified freedoms to citizens and contains provisions permitting specified restrictions. Article 21 protects life and personal liberty. These headings are study anchors, not a complete account of each right. Constitution, 2024 edition: Articles 14, 19 and 21

Article 32 guarantees the right to approach the Supreme Court through appropriate proceedings to enforce the rights conferred by Part III. It is not a promise that every legal disagreement is automatically an Article 32 case. Constitution: Article 32

Worked matching example

An original practice exercise offers four labels: equality, specified freedoms, life and personal liberty, and constitutional remedy. Match descriptions before recalling numbers.

  1. A card asks which provision concerns equal protection of laws. The concept is equality, so match Article 14.
  2. A card asks about the citizen's freedom of speech and expression. Match Article 19, then remember that the Article also sets out restrictions; the word freedom does not mean unlimited permission.
  3. A card names life and personal liberty. Match Article 21.
  4. A card asks for the guaranteed route to the Supreme Court for enforcing a Part III right. The question concerns the remedy, so choose Article 32.

This is a classification exercise. A real case requires its facts and the relevant law; the cards do not decide the outcome of a dispute.

Common mistake

“All rights have identical wording” is false. Notice “person” and “citizen” where the text uses them. Also distinguish the right being protected from the provision used to seek its enforcement.

Check yourself

  1. Does Article 32 describe enforcement of any possible legal right? No. Its guarantee concerns rights conferred by Part III.
  2. Is Article 14 written only for citizens? No. Its text uses persons within India's territory.
  3. Does the existence of Article 19 mean its freedoms have no constitutional restrictions? No. Read its relevant clauses.
