Federal Law-Making: Read the Union, State and Concurrent Lists

Lesson 6 of 66 minFree

Learning goal

Classify selected legislative subjects using the Seventh Schedule and keep the list structure separate from the resolution of a legal conflict.

Three lists organise legislative subjects

Article 246 distributes law-making powers with reference to the Seventh Schedule. List I is the Union List; List II is the State List; List III is the Concurrent List. Parliament legislates on Union subjects; State legislatures legislate on State subjects subject to the constitutional scheme; both can legislate on Concurrent subjects. Qualifications and special constitutional provisions matter. Constitution, 2024 edition: Article 246

Worked sorting exercise

An original practice sheet asks for the list containing three subjects. Read the actual entries, not a guess about which government seems closer to the activity.

  1. Defence of India appears in Union List Entry 1. Put the card in List I.
  2. Police appears in State List Entry 2, subject to Union List Entry 2A. Put the basic subject card in List II, keeping that qualification with it.
  3. Education appears in Concurrent List Entry 25, subject to the specified Union List entries 63–66. Put it in List III; do not change it to State List merely because a particular school is local.
  4. Check the explanation: we classified legislative subjects. We did not decide who runs every institution or which particular law prevails in a dispute. Constitution: Seventh Schedule

Why “both can legislate” is not the last step

A second question says that two laws on a Concurrent subject appear inconsistent. The List III label establishes a shared legislative field; it does not by itself resolve the conflict. Article 254 contains the relevant constitutional rules and qualifications. Do not replace that analysis with “one side always wins.” This lesson stops at introductory classification. Constitution: Article 254

Common mistake

Local location does not automatically mean State List. Also, lists allocate legislative subject matter; a short matching answer is not a complete opinion on the validity of a law.

Check yourself

  1. Which list is the shared field for Parliament and State legislatures? List III, the Concurrent List, within the constitutional scheme.
  2. Defence of India belongs to which list? Union List, Entry 1.
  3. Can the word Concurrent alone settle every conflict between two laws? No. Read the applicable constitutional rules and facts.
